People who spent many years cheering for and defending ... programs of mass surveillance are suddenly indignant now that they know the eavesdropping included them. Long-time GOP chairman of the House Intelligence Committee and unyielding NSA defender Pete Hoekstra last night was truly indignant: "WSJ report that NSA spied on Congress and Israel communications very disturbing. Actually outrageous. Maybe unprecedented abuse of power ... NSA and Obama officials need to be investigated and prosecuted. NSA loses all credibility. Scary." This pattern - whereby political officials who are vehement supporters of the Surveillance State transform overnight into crusading privacy advocates once they learn that they themselves have been spied on - is one that has repeated itself over and over. So now, with yesterday’s WSJ report, we witness the tawdry spectacle of large numbers of people who for years were fine with, responsible for, and even giddy about NSA mass surveillance suddenly objecting. Overnight, privacy is of the highest value because now it’s their privacy, rather than just yours, that is invaded.

For the Wealthiest, a Private Tax System That Saves Them Billions

The very richest Americans have financed a sophisticated and astonishingly effective apparatus for shielding their fortunes. Some call it the “income defense industry,” consisting of a high-priced phalanx of lawyers, estate planners, lobbyists and anti-tax activists. All are among a small group providing much of the early cash for the 2016 presidential campaign. Operating largely out of public view - in tax court, through arcane legislative provisions and in private negotiations with the Internal Revenue Service - the wealthy have used their influence to steadily whittle away at the government’s ability to tax them. The effect has been to create a kind of private tax system, catering to only several thousand Americans. Two decades ago ... the 400 highest-earning taxpayers in America paid nearly 27 percent of their income in federal taxes, according to I.R.S. data. By 2012 ... that figure had fallen to less than 17 percent, which is just slightly more than the typical family making $100,000 annually. Some of the biggest current tax battles are being waged by some of the most generous supporters of 2016 candidates. Matthew Herder, [a] health law associate professor ... is calling on other doctors, researchers and journalists to bombard Ottawa with their own demands for drug industry data, using [a] new legislative lever written into ... the Protecting Canadians from Unsafe Drugs Act, which was passed late last year. Today, in the Canadian Medical Association Journal, Herder is urging Canadians to use the clause [to request] data that has long been protected by a wall of bureaucratic and corporate secrecy. The European Medicines Agency has started publishing all of the clinical reports submitted as part of drug marketing authorization applications - the same material Health Canada refuses to disclose. Almost half of the drug trials remain secret. ‘The Big Short,’ Housing Bubbles and Retold Lies

In May 2009 Congress created a special commission to examine the causes of the financial crisis. Some commission members sought to block consideration of any historical account that might support efforts to rein in runaway bankers. One ... wrote [that] it was important that what they said “not undermine the ability of the new House G.O.P. to modify or repeal Dodd-Frank,” the financial regulations introduced in 2010. Never mind what really happened; the party line, literally, required telling stories that would help Wall Street do it all over again. Which brings me to a new movie the enemies of financial regulation really, really don’t want you to see. “The Big Short” is based on the Michael Lewis book of the same name, one of the few real best-sellers to emerge from the financial crisis. It does a terrific job of making Wall Street skulduggery entertaining. Many influential, seemingly authoritative players, from Alan Greenspan on down, insisted not only that there was no bubble but that no bubble was even possible. And the bubble whose existence they denied really was inflated largely via opaque financial schemes that in many cases amounted to outright fraud - and it is an outrage that basically nobody ended up being punished for those sins aside from innocent bystanders, namely the millions of workers who lost their jobs and the millions of families that lost their homes. While the movie gets the essentials of the financial crisis right, the true story of what happened is deeply inconvenient to some very rich and powerful people.

Truth and Reconciliation Commission's report details deaths of 3,201 children in residential schools

More than 3,000 indigenous children and youth died in residential schools - many of them buried in unmarked graves - and those who had the power to prevent these deaths did little to stop it. The heartbreaking details of those deaths are contained in the final report of the Truth and Reconciliation Commission (TRC) released Tuesday, which details the dark history and unsettling legacy of Canadian residential schools that saw 150,000 First Nations, Métis and Inuit children come through their doors. “Many students who went to residential school never returned,” says the final report. “They died at rates that were far higher than those experienced by the general school-aged population. Their parents were often uninformed. No one took care to count how many died or to record where they were buried.” says the final report, [which] includes a volume titled “Missing Children and Unmarked Burials” detailing the circumstances, when known, of the 3,201 students deaths between 1867 and 2000 it was able to record. “Both the regulatory regime in which the schools operated and the level of compliance with that regime were inadequate to the task of protecting the health and safety of the students. "Government, church, and school officials were well aware of these failures and their impact on student health. If the question is, ‘Who knew what when?’ the clear answer is, ‘Everyone in authority at any point in the system’s history was well aware of the health and safety conditions in the schools,’ ” the report concludes.

Evidence still raises questions over World Trade Center collapses

Alex Beam’s portrayal of “architect truthers” is yet another disappointing example of a journalist resorting to ad hominem attacks and avoiding the facts when discussing the destruction of the three World Trade Center skyscrapers on Sept. 11, 2001 (The ‘truthers’ and 9/11). Sadly, not one sentence of Beam’s column examines the evidence for or against the controlled demolition of the Twin Towers and WTC Building 7. Instead, he devotes 600 words to revealing his own ill-founded bias. Noting that some Americans think that what happened that day hasn’t “been fully explained,” he declares, “I don’t agree,” but gives no evidence-based reason for disagreeing. As building professionals, we at Architects & Engineers for 9/11 Truth try not to let personal feelings interfere with investigating the three worst structural failures in modern history. Nearly 2,400 architects and engineers, not including the 109 who signed our petition at the recent annual trade show ABX, have joined us because we stick to science. The physical evidence shows that scattered office fires could not have caused the 47-story WTC 7 to collapse symmetrically into its footprint. The evidence also shows that the twin towers were not leveled by the airplane impacts and ensuing fires. The implications are indeed far-reaching, and that is why we urge people to study all the evidence before reaching a conclusion.

TSA's emergency powers are doing more harm than good

They posed as travelers, packing fake bombs into suitcases and checking them at ticket counters in airports. Then the team of covert inspectors from the Department of Homeland Security tracked the response of the Transportation Security Administration (TSA). Since 2008, TSA has spent more than $2 billion to improve the screening of checked baggage ... through a little-known power that lets the agency ignore every rule and law controlling government spending. The loophole [is] known as “other transaction” authority. In June, Homeland Security Inspector General John Roth found that TSA failed to catch threats at passenger checkpoints a staggering 96% of the time. In January 2014, TSA began paying the American Public Transportation Association (APTA) $1.5 million a year via other transaction authority for a series of publications ... that it circulates to lawmakers and government officials. The lobbyists in turn have spent $3 million since then influencing the bill that funds TSA. TSA’s payments to APTA don’t violate the federal Anti-Lobbying Act, which criminalizes the use of federal funds to lobby members of government, because the Justice Department has interpreted the law to apply only to grassroots campaigns.

CIA runs shadow war with Afghan militia implicated in civilian killings

Months after the Obama administration declared combat operations over in Afghanistan, the CIA continues to run a shadow war in the eastern part of the country, overseeing an Afghan proxy called the Khost Protection Force [KPF], according to local officials, former commanders of that militia and Western advisers. The highly secretive paramilitary unit has been implicated in civilian killings, torture, questionable detentions, arbitrary arrests and use of excessive force in controversial night raids. In several attacks, witnesses described hearing English being spoken by armed men who had interpreters with them, suggesting American operatives were present during assaults where extreme force was used. Afghan government officials acknowledge that the KPF has killed civilians and committed other abuses. In Khost, the KPF is more influential than the Afghan army and police, and is unaccountable to the provincial government. The CIA [directs] the KPF’s operations, paying fighters’ salaries, and training and equipping them. The CIA is not bound by the Bilateral Security Agreement between Afghanistan and Washington that, among other rules, limits the ability of U.S. military forces to enter Afghan homes. The KPF was one of several large paramilitary forces created by the CIA in the months after the Taliban was ousted following the 9/11 attacks.

Erin Brockovich: The Biotech Industry Is Jeopardizing Our Health

The new movie Consumed tackles the controversial world of Genetically Modified Organisms (GMOs) in unprecedented fashion, offering insight into their risks. Its message could not be more timely in the wake of the recent news that the Food and Drug Administration has approved the first genetically engineered salmon for human consumption. The fish, like all genetically engineered ingredients in this country, will not be labeled, leaving American consumers in the dark. Like many food and environmental safety activists around the world, I’m outraged. The biotech industry and the FDA have hijacked not only our basic rights as consumers, but also our fundamental human rights in the face of corporate monopolization of our food supply. They are jeopardizing our health and the environment more than ever before. In detailed comments submitted to the FDA, Michael Hansen, senior scientist at Consumers Union, argues the FDA review process was based on “sloppy science” and the genetically engineered salmon could pose many risks. “Because FDA’s assessment is inadequate, we are particularly concerned that this salmon may pose an increased risk of severe, even life-threatening allergic reactions,” he writes. The majority of Americans ... believe they have a fundamental right to know what is in their food. A 2013 New York Times poll found that 93% of Americans want GMOs to be labeled. More than 60 countries label GMOs, and in some cases even ban them, but the U.S. still does not.

Justice Department watchdogs ran into an unexpected roadblock last year when they began examining the role of federal drug agents in the fatal shootings of unarmed civilians during raids in Honduras. The continuing Honduran inquiry is one of at least 20 investigations across the government that have been slowed, stymied or sometimes closed because of a long-simmering dispute between the Obama administration and its own watchdogs over the shrinking access of inspectors general to confidential records. The impasse has hampered investigations into an array of programs and abuse reports - from allegations of sexual assaults in the Peace Corps to the F.B.I.’s terrorism powers. “The bottom line is that we’re no longer independent,” Michael E. Horowitz, the Justice Department inspector general, said. The new restrictions grew out of a five-year-old dispute within the Justice Department. After a series of scathing reports by Glenn Fine, then the Justice Department inspector general, on F.B.I. abuses in counterterrorism programs, F.B.I. lawyers began asserting in 2010 that he could no longer have access to certain confidential records. Tensions are common between the watchdogs and the officials they investigate. But ... the restrictions imposed by the Obama administration reflect a new level of acrimony. “This is by far the most aggressive assault on the inspector general concept since the beginning,” said Paul Light, a New York University professor.

CNN Punished Its Own Journalist for Fulfilling a Core Duty of Journalism

CNN yesterday suspended its global affairs correspondent, Elise Labott, for two weeks for the crime of posting a tweet critical of the House vote to ban Syrian refugees. Whether by compulsion or choice, she then groveled in apology. Labott’s crime wasn’t that she expressed an opinion. It’s that she expressed the wrong opinion: After Paris, defending Muslims, even refugees, is strictly forbidden. I’ve spoken with friends who work at every cable network and they say the post-Paris climate is indescribably repressive in terms of what they can say and who they can put on air. When it comes to the Paris attacks, CNN has basically become state TV. Labott’s punishment comes just five days after two CNN anchors spent six straight minutes lecturing French Muslim civil rights activist Yasser Louati that he and all other French Muslims bear “responsibility” for the attack. In the wake of Paris, an already ugly and quite dangerous anti-Muslim climate has exploded. The leading GOP presidential candidate is speaking openly of forcing Muslims to register in databases, closing mosques, and requiring Muslims to carry special ID cards. Others are advocating exclusion of Muslim refugees (Cruz) and religious tests to allow in only “proven Christians” (Bush). That, by any measure, is a crisis of authoritarianism. And journalists have historically not only been permitted, but required, to raise their voice against such dangers.

The latest criticism comes from Drone, a new documentary about the CIA’s covert drone war. To help promote the film and inveigh against the agency’s drone program ... four former operators - Stephen Lewis, Michael Haas, Cian Westmoreland and Brandon Bryant - appeared at a press conference. Speaking out can lead to veiled threats and prosecution. Which is why for years Bryant was the only drone veteran who openly rebuked the drone war. But his persistence and his appearance in the film, the other three say, inspired them to come forward. On multiple occasions, the men say they complained to their superiors about their concerns to no avail. Drone strikes kill far more civilians than the government admits. These deaths, they argue, wind up helping militant groups recruit new members and hurt the U.S.’s long-term security. By distancing soldiers from the battlefield, the operators suggest the people carrying out strikes may become even more desensitized to killing than their counterparts on the front lines. On some occasions, Haas says operators referred to children as “fun-sized terrorists” or “TITS,” terrorists in training.

Mass Surveillance Isn’t the Answer to Fighting Terrorism

It’s a wretched yet predictable ritual after each new terrorist attack: Certain politicians and government officials waste no time exploiting the tragedy for their own ends. The remarks on Monday by John Brennan, the director of the Central Intelligence Agency, took that to a new and disgraceful low ... after coordinated terrorist attacks in Paris killed 129. Mr. Brennan complained about ... the sustained national outrage following the 2013 revelations by Edward Snowden, a former National Security Agency contractor, that the agency was using provisions of the Patriot Act to secretly collect information on millions of Americans’ phone records. It is hard to believe anything Mr. Brennan says. Last year, he bluntly denied that the C.I.A. had illegally hacked into the computers of Senate staff members conducting an investigation into the agency’s detention and torture programs when, in fact, it did. In 2011 ... he claimed that American drone strikes had not killed any civilians, despite clear evidence that they had. And his boss, James Clapper Jr., the director of national intelligence, has admitted lying to the Senate on the N.S.A.’s bulk collection of data. Even putting this lack of credibility aside, it’s not clear what extra powers Mr. Brennan is seeking. Most of the men who carried out the Paris attacks were already on the radar of intelligence officials in France and Belgium, where several of the attackers lived. The problem in this case was not a lack of data. In fact, indiscriminate bulk data sweeps have not been useful.

The very next day, Upton delivered on the industry’s aspirations: He rushed a bill through his legislative panel that would not only streamline the approval process for new pipelines but also empower federal officials to impose tight deadlines ... to review their potential environmental impacts. While joint fundraising committees have been a part of politics for decades ... the Murkowski-Upton committee stands out as a uniquely explicit means of influencing legislation, say campaign finance experts, because it ... gives the oil and gas industry an opportunity to write one check knowing the proceeds are reaching the leaders of the two panels that write the rules regulating their business.

Reid died following shocks administered seemingly in violation of national guidelines. These rules ... acknowledge the lethal potential of electronic control weapons (ECW) deployed for more than three standard shock cycles of five seconds each. Many police departments are still not regulating the use of Tasers in accordance with these nationally accepted standards. Taser International, which sells ECWs to 17,800 of the United States’ roughly 18,000 law enforcement agencies and commands an overwhelming monopoly on the market, has ... sued medical examiners in the past, in one case leading to the examiners’ representative body to state that Taser International’s actions were “dangerously close to intimidation”. The weapons are likely responsible for many more deaths than coroners can easily record. An epidemiological study on the in-custody death rates of 50 California police departments ... found a startling 600% increase in sudden-death incidents in the year after Taser introduction, and then a 40% increase over pre-Taser rates for the next four years.

The Environmental Protection Agency concluded in June that there was “no convincing evidence” that glyphosate, the most widely used herbicide in the U.S. and the world, is an endocrine disruptor. The decision was based almost entirely on pesticide industry studies. Most of the studies were sponsored by Monsanto or an industry group called the Joint Glyphosate Task Force. Of the small minority of independently funded studies that the agency considered in determining whether the chemical poses a danger to the endocrine system, three of five found that it did. One, for instance, found that exposure to glyphosate-Roundup “may induce significant adverse effects on the reproductive system of male Wistar rats.” Another concluded that “low and environmentally relevant concentrations of glyphosate possessed estrogenic activity.” And a review of the literature turns up many more peer-reviewed studies finding glyphosate can interfere with hormones. Many of the industry-funded studies contained data that suggested that exposure to glyphosate had serious effects. Yet in each case, sometimes even after animals died, the scientists found reasons to discount the findings — or to simply dismiss them. Having companies fund and perform studies that affect them financially [is] the standard practice at EPA. The International Agency for Research on Cancer labeled glyphosate a probable carcinogen in March.

Broken system lets problem officers jump from job to job

A yearlong Associated Press investigation into sex abuse by cops, jail guards, deputies and other state law enforcement officials uncovered a broken system for policing bad officers, with significant flaws in how agencies deal with those suspected of sexual misconduct and glaring warning signs that go unreported or get overlooked. The AP examination found about 1,000 officers in six years who lost their licenses because of sex crimes that included rape, or sexual misconduct ranging from propositioning citizens to consensual but prohibited on-duty intercourse. That number fails to reflect the breadth of the problem, however, because it measures only officers who faced an official process called decertification and not all states have such a system or provided records. In states that do revoke law enforcement licenses, the process can take years, enabling problem officers to find other jobs. And while there is a national index of decertified officers [containing] the names of nearly 20,000 officers who have lost their licenses for problems that include sex abuse ... contributing is voluntary, and only 39 states do so. Michael Ragusa - now serving a 10-year prison sentence after being convicted of sexually assaulting three women - admitted during the hiring process with the Miami Police Department that he'd solicited a prostitute, committed theft, sold stolen property and abused a relative. The investigator in charge of his background check had himself been disciplined 26 times and was once arrested for falsifying documents.

The Steady Trickle-Up From the Poor to the Rich

Much of the national debate about widening inequality ... ignores the upward redistributions going on every day, from the rest of us to the rich. These redistributions are hidden inside the market. The only way to stop them is to prevent big corporations and Wall Street banks from rigging the market. For example, Americans pay more for pharmaceuticals than do the citizens of any other developed nation. This costs you and me an estimated $3.5 billion a year - a hidden upward redistribution of our incomes to Pfizer, Merck and other big proprietary drug companies. Likewise, the interest we pay on ... loans is higher than it would be if the big banks ... had to work harder to get our business. As recently as 2000, America’s five largest banks held 25 percent of all U.S. banking assets. Now they hold 44 percent — which gives them a lock on many such loans. The net result: another hidden upward redistribution. Why have food prices been rising faster than inflation, while crop prices are now at a six-year low? Because the giant corporations that process food have the power to raise prices. Result: a redistribution from average consumers to Big Agriculture. Why do you suppose health insurance is costing us more? Health insurers are hiking rates 20 to 40 percent next year, and their stock values are skyrocketing. Add it up - the extra money we’re paying for pharmaceuticals, Internet communications, home mortgages, student loans, airline tickets, food and health insurance - and you get a hefty portion of the average family’s budget.

Robert Fisk on Saudi Prince busted with 40 suitcases of drugs at Beirut airport

Earlier this week, Saudi Prince Abdul Mohsen bin Walid bin Abdul Aziz al-Saud was arrested in Lebanon. According to reports, the prince and four other Saudis were attempting to fly out of the Beirut airport in a private jet - chock full of drugs. "Apparently most of it was called Captagon ... a kind of amphetamine," [said Robert Fisk], Middle East correspondent for the Independent newspaper. He says that a customs guard at Beirut airport became suspicious when the prince showed up with 40 suitcases. Fisk explains, "So he said, 'You put the baggage through the x-ray machine,' and the Saudi said, 'No, no, I have a diplomatic passport,' and he said, 'You have a diplomatic passport but the baggage does not have diplomatic clearance." The prince was immediately detained. "The photographs which have been leaked out, show boxes, very large boxes with the Saudi royal coat of arms on the front which is a bit unfortunate," Fisk quips. "I think what's actually happening is that the Lebanese do not want to embarrass the Saudis." According to Fisk, the story has already disappeared from the papers and it is still unclear where the drugs were intended to be delivered. "This after all, is a state that chops off the heads of drug traffickers usually from poor countries like Pakistan or Sri Lanka," Fisk adds. "They certainly don't want too much publicity when a Prince is suddenly found possessing all this stuff and trying to cheat his way through the airport."

Note: Despite being caught red-handed in what may be Lebanon's biggest drug bust ever, Fisk believes this royal prince will escape punishment. Remember Saudi Arabia is run by the royal family.
