FBI director Robert S. Mueller III today disclosed that the FBI is investigating leaks to the news media about the recently disrupted plot by Al Qaeda’s Yemen affiliate to smuggle a bomb designed to be concealed in underwear onto a U.S. bound jet. The plans for the attack, which featured a more sophisticated version of the device the “underwear bomber” of Christmas 2009 was arrested with, were first revealed by the AP. But a day later, it was revealed that the individual at the center of the plot was a double agent working for Britain’s MI-6 secret intelligence service and the CIA along with Saudi Arabian intelligence assets. “We have initiated an investigation into this leak,” Mueller testified before the Senate Judiciary Committee on Wednesday. Justice Department officials and an FBI spokesman declined to comment on the nature of the investigation. The CIA also declined comment. Matthew Olsen, director of the National Counterterrorism Center, addressed the issue of media leaks relating to the plot and called it “devastating.”

A judge on [May 16] blocked enforcement of a recently enacted law's provision that authorizes indefinite military detention for those deemed to have "substantially supported" al Qaeda, the Taliban or "associated forces." District Judge Katherine Forrest in Manhattan ruled in favor of a group of civilian activists and journalists who said they feared being detained under a section of the law, which was signed by President Barack Obama in December 2011. "In the face of what could be indeterminate military detention, due process requires more," the judge said. She added that it was in the public interest to reconsider the law so that "ordinary citizens are able to understand the scope of conduct that could subject them to indefinite military detention." By issuing a preliminary injunction, the judge prevents the U.S. government from enforcing section 1021 of the National Defense Authorization Act's "Homeland Battlefield" provisions. During day-long oral arguments in March, Forrest heard lawyers for former New York Times war correspondent and Pulitzer Prize winner Chris Hedges and others argue that the law would have a "chilling effect" on their work. The judge said she worried at the government's reluctance ... to specify whether examples of the plaintiffs' activities ... would fall under the scope of the provision. "Failure to be able to make such a representation... requires the court to assume that, in fact, the government takes the position that a wide swath of expressive and associational conduct is in fact encompassed by 1021," the judge wrote.

What strikes Phil Angelides the most about the $2 billion (and counting) loss sustained by JPMorgan Chase on a big trade gone bad, is how little has changed since the financial crash of 2008. "The big banks continue to be casinos," said the chairman of the government-appointed Financial Crisis Inquiry Commission, which laid out how such trades, referred to in some quarters as "bets," contributed to the crash that the country is still struggling to pull itself out of. "It has to be stopped," he said. Trouble is - as Angelides, the former California state treasurer, and others point out - no one is stopping them. Jamie Dimon, JPMorgan's CEO, dismissed initial concerns about the trades last month as a "complete tempest in a teapot." His main concern, he told analysts, was how the affair "plays right into the hands of a bunch of pundits out there." Dimon was referring to those who have been pushing for regulations to prevent federally insured banks like JPMorgan from indulging in such trades in the first place. "They've been fighting a ferocious rear-guard, no-holds-barred action," said Angelides, referring to the army of lobbyists hired and millions of dollars spent to beat back the regulations. The Securities and Exchange Commission is investigating the trades, which involved the use of complex financial instruments called credit default swaps as a hedge against the value of U.S. bonds.

Jamie Dimon was reelected chairman and CEO of JPMorgan Chase yesterday afternoon. He got to keep his $23 million pay package, too. This means that at ... three of the top five bank holding companies dominating U.S. derivatives exposure, loans, assets, and deposits, the same man holds the chairman and CEO positions -— at Goldman Sachs, Wells Fargo, and JPM Chase. At the shareholders meeting there was no mention of the details behind the “mistake” that cost the bank $2 billion, just that it “should never have happened.” The fact that after a formal announcement, a friendly Meet the Press chat, and a face-to-face with the firm's shareholders, Dimon can still call it a mistaken hedge is ludicrous. It was a directional bet on the health of North American corporate bonds that the firm got wrong, enacted via the synthetic derivatives market, to worsen the blow. To the extent that it's betting wrong, it's a mistake, but it's not a hedge. Included in the proxy materials in the shareholder package that went out before the vote was ... a wealth of negativity about regulations. The letter stressed that ... two regulations would actively hurt the bank's “competitive ability, the Volker Rule and the derivatives rules.” JPM Chase holds nearly $70 trillion of derivatives exposure on $1.8 trillion of assets. Bank chairmen, like Jamie Dimon ... claim that regulation is too complex, too anti-competitive, and too un-American (putting U.S. banks at a disadvantage against other global banks). [Yet] pretending that it's okay to allow dormant volcanoes of risk to remain embedded in big bank balance sheets, supported by customer money and taxpayer guarantees is not sensible.

Goldman Sachs and Merrill Lynch employees discussed helping naked short-sales by market-maker clients in e-mails the banks sought to keep secret, including one in which a Merrill official told another to ignore compliance rules, Overstock.com ... said in a court filing. The online retailer accused Merrill, now part of Bank of America and Goldman Sachs of manipulating its stock from 2005 to 2007, causing its shares to fall. Lawyers for Overstock ... asked a judge to make public e-mails sent in 2005 and 2006 that it said “reflect business decisions to put profits and corporate ambition over compliance” at Goldman Sachs and Merrill. The banks’ decisions to intentionally fail to deliver Overstock shares caused large-scale naked short selling of the company’s stock, according to the filing. Four media organizations, including Bloomberg, the New York Times, Wenner Media and The Economist, intervened in the Overstock case and joined the company’s request to unseal court files. Bloomberg News obtained a copy of the filing describing the e-mails.

It has been revealed that ailing imaging company Kodak had a secret nuclear reactor hidden in a US research facility for more than 30 years. The reactor, which contained 1.5kg of enriched "weapons-grade" uranium, was a Californium Flux Multiplier (CFX) acquired by the company in 1974 and only decommissioned in 2006. "The uranium used in the CFX was highly enriched, but ... was not easily adaptable to creating a nuclear weapon," company spokesman Christopher Veronda told Fairfax Media. While the reactor was not used to generate power and therefore was not at risk of a meltdown, it was still vulnerable to radiation leaks. "These devices are very rare," said Miles Pomper, a senior research associate at the Center for Nonproliferation Studies in Washington, D.C. "According to the decommissioning plan submitted by Kodak it is only one of two such devices ever produced - and the only one for private industry," Mr Pomper [said]. The CFX, which was roughly the size of a domestic refrigerator, was used for neutron multiplication, an analytical method. Kodak used it to test chemicals for impurities, and to perform neutron radiography - an imaging technique in which neutrons are passed through an object [and] then produce an image of the object as they expose a photographic film. If the reactor really was secure, it poses the question: why was it decommissioned? Kodak claims that in 2003 it made the decision to pursue alternative, more cost-effective methods of analysis. The uranium was removed in 2007 and taken to a government facility in South Carolina.

Antonin Scalia, one of the nine justices on the US supreme court, made a bold statement. It is now clear that a person was executed for a crime he did not commit, and his name – Carlos DeLuna – is being shouted from the rooftops of the Columbia Human Rights Law Review. Carlos DeLuna was arrested, aged 20, on 4 February 1983 for the brutal murder of a young woman, Wanda Lopez. From the moment of his arrest until the day of his death by lethal injection six years later, DeLuna consistently protested he was innocent. The august journal has cleared its entire spring edition, doubling its normal size to 436 pages, to carry an extraordinary investigation by a Columbia law school professor and his students. The book sets out in precise and shocking detail how an innocent man was sent to his death on 8 December 1989, courtesy of the state of Texas. Los Tocayos Carlos: An Anatomy of a Wrongful Execution, is based on six years of intensive detective work by Professor James Liebman and 12 students. What they discovered stunned even Liebman, who, as an expert in America's use of capital punishment, was well versed in its flaws. "It was a house of cards. We found that everything that could go wrong did go wrong," he says.

Large numbers of the famed Tennessee Walking Horses have been tortured and beaten in order to make them produce the high-stepping gait that wins championships, an ABC News investigation has found. "All too often, you have to cheat to win in this sport," said Keith Dane of the Humane Society of the United States. In the most recent example, an undercover video made by an investigator for the Humane Society documents the cruelty of one of the sport's leading trainers, Jackie McConnell of Collierville, Tennessee. The tape shows McConnell and his stable hands beating horses with wooden sticks and using electric cattle prods on them as part of a training protocol to make them lift their feet in the pronounced gait judges like to see. In another scene, McConnell oversees his hands as they apply caustic chemicals to the ankles of the horses and them wrap them with plastic wrap so the chemicals eat into the skin. "That creates intense pain and then the ankles are wrapped with large metal chains so the horses flinch, or raise their feet even higher," said Dane. Leaders of the Tennessee Walking Horse industry maintain that such brutality is rare and that trainers do not have to cheat to win championships, which can add millions of dollars to the value of horses. But a random inspection by the agents of the Department of Agriculture at last year's annual championship found that 52 of 52 horses tested positive for some sort of foreign substance around front hooves, either to cause pain or to hide it.

A 58-year-old woman paralyzed by a stroke was all smiles after sipping her cinnamon latte with the help of a mind-controlled robotic arm. Cathy Hutchinson is one of two tetraplegic patients able to reach and grasp with a robotic limb linked to [a] tiny sensor in her brain, according to a study published today in the journal Nature. The device, called BrainGate, bypasses the nerve circuits broken by the brainstem stroke and replaces them with wires that run outside Hutchinson's body. The implanted sensor is about the size of a baby aspirin. "You can go from the brain ... directly to a device like a computer or a robotic arm," said BrainGate developer John Donoghue, director of the Institute for Brain Science at Brown University in Providence, R.I. "This can help restore independence to a person who was completely reliant on other people for every activity, whether it's brushing their teeth, eating their dinner or taking a drink." Hutchinson, who has been unable to move or speak for 15 years, had the 96-channel sensor implanted in her brain's motor cortex in 2005. Since then, the BrainGate team has been fine-tuning the system to give her back some of the control she lost. With its hair-like electrodes, the BrainGate sensor taps into the flurry of brain activity, recording electrical signals that can be translated into movement commands. "It's like learning a language," Donoghue said of the translation process, a series of mathematical calculations that copy the brain's processing ability.

Teleportation is real. Using powerful lasers and optics to manipulate photons, or units of light, researchers in China set a record for teleporting a photon more than 10 miles (16 km), TIME reported in 2010. Now a different team of physicists at the University of Science and Technology of China in Shanghai says it has shattered that record, claiming to have sent a photon more than 60 miles (97 km). Quantum teleportation, which has been around since 1997, is a little different than what you see in sci-fi movies. Teleportation is the ability [to] move one object from one place to another without traversing the space in between. The actual object is not moving from point A to point B. Rather, the distant photon mirrors the information contained by the original photon, essentially becoming an identical twin. The team’s greatest contribution is not necessarily the distance it made the data travel but the method it used to harness the 1.3-watt laser beam that carries it. The longer a beam of light travels, the more it spreads out, causing the photon to lose information and trail off course. To keep the beam on target, the researchers created a technique that focuses and steers the laser. Though beaming up humans and animals ŕ la Star Trek is not on the agenda anytime soon, as the technology becomes more sophisticated, it will likely be applied to military communication. Theoretically, this method cannot be cracked or intercepted.

This is the story of hundreds, if not thousands, of foreign language documents that the FBI neglected to translate before and after the Sept. 11 attacks -- documents that detailed what the FBI heard on wiretaps and learned during interrogations of suspected terrorists. Sibel Edmonds, a translator who worked at the FBI's language division, says the documents weren't translated because the division was riddled with incompetence and corruption. Edmonds was fired after reporting her concerns to FBI officials. She told her story behind closed doors to investigators in Congress and to the Justice Department. Most recently, she spoke with the commission investigating the Sept. 11 attacks. Because she is fluent in Turkish and other Middle Eastern languages, Edmonds, a Turkish-American, was hired by the FBI soon after Sept. 11 and given top-secret security clearance to translate some of the reams of documents seized by FBI agents who have been rounding up suspected terrorists across the United States and abroad. Edmonds says that to her amazement, from the day she started the job, she was told repeatedly by one of her supervisors that there was no urgency, that she should take longer to translate documents so that the department would appear overworked and understaffed. That way, it would receive a larger budget for the next year. Edmonds says that the supervisor, in an effort to slow her down, went so far as to erase completed translations from her FBI computer after she'd left work for the day.

The Justice Department appears to be hiding behind national security fears in an attempt to dodge a wrongful dismissal suit. Former FBI linguist Sibel Edmonds claims she was fired in retaliation for blowing the whistle on security breaches she says hampered translation of documents and communications related to the Sept. 11 terrorist attacks. She filed suit to get her job back, but recently a federal judge tossed out her case, not on its merits but on the grounds that hearing her claims might expose government secrets and damage national security. That keeps under wraps the inspector general's report that investigated Edmonds' allegations. U.S. District Judge Reggie Walton, a Bush appointee, said he couldn't explain himself further because the explanation itself might expose sensitive secrets. He did say that he'd accepted Attorney General John Ashcroft's explanation that the suit could "expose intelligence-gathering methods and disrupt diplomatic relations with foreign governments." The Boston Globe reported that Ashcroft ordered material in the case retroactively classified. Edmonds must feel a bit like Alice at the tea party, where justice is not being served, and where a secret is a secret but why it's a secret or who says it's a secret is a secret, and we can't tell you why because it's a secret.

A would-be "underwear bomber" involved in a plot to attack a US-based jet was in fact working as an undercover informer with Saudi intelligence and the CIA, it has emerged. The revelation is the latest twist in an increasingly bizarre story about the disruption of an apparent attempt by al-Qaida to strike at a high-profile American target using a sophisticated device hidden in the clothing of an attacker. The news that the individual at the heart of the bomb plot was in fact an informer for US intelligence is likely to raise just as many questions as it answers. Citing US and Yemeni officials, Associated Press reported that the unnamed informant was working under cover for the Saudis and the CIA when he was given the bomb, which was of a new non-metallic type aimed at getting past airport security. The informant then turned the device over to his handlers and has left Yemen, the officials told the news agency.

A cycle of overhyped terror plots involving government agency entrapment feeds a multimillion-dollar surveillance industry. The news stories ... quickly surface, long enough to cause scary headlines, then vanish before people can learn how often the cases are thrown out. These are stories about "bumbling fantasists", hapless druggies, the aimless, even the virtually homeless and mentally ill, and other marginal characters with not the strongest grip on reality, who have been lured into discourses about violence against America only after assiduous courting, and in some cases outright payment, by undercover FBI or police informants. But the tales of entrapment and terror hype continue apace – ten years after 9/11. Now we have another "underwear bomber" – declared by the Pentagon to have been about to launch a major attack via a US-bound plane, but who appears, reportedly, to have been a CIA-run double agent. What is the evidence that the "device", which is supposedly so sophisticated that there is doubt as to whether existing surveillance technologies in US airports would have caught it, actually exists? It is important to note that we can no longer assume that the FBI and the CIA and the NSA work ... for the safety of the American people; they [now] represent a revolving door of government officials who become security industry lobbyists and manufacturers, which, in turn, get the multimillion-dollar contracts for tackling the very problems these stories [hype].

Late last year, fishermen began finding dead dolphins, hundreds of them, washed up on Peru’s northern coast. Now, seabirds have begun dying, too, and the government has yet to conclusively pinpoint a cause. Officials insist that the two die-offs are unrelated. The dolphins are succumbing to a virus, they suggest, and the seabirds are dying of starvation because anchovies are in short supply. There is growing suspicion among the public and scientists that there might be more to the story. Some argue that offshore oil exploration could be disturbing wildlife, for example, and others fear that biotoxins or pesticides might be working their way up the food chain. At least 877 dolphins and more than 1,500 birds, most of them brown pelicans and boobies, have died since the government began tracking the deaths in February, the Environment Ministry said last week. The dolphins, many of which appeared to have decomposed in the ocean before washing ashore, were found in the Piura and Lambayeque regions, not far from the border with Ecuador. The seabirds, which seem mostly to have died onshore, have been found from Lambayeque to Lima. In offshore seismic testing, ships tow arrays of air guns that release high-pressure air under water, producing sound waves that can be analyzed to locate oil and gas deposits deep under the ocean floor.

The five men accused of plotting the Sept. 11 attacks used their weekend war court appearances to stage “peaceful resistance to an unjust system” being used for political reasons, defense lawyers said Sunday — a day after the 9/11-accused turned the judge’s plans to hold a simple arraignment into a 13-hour marathon of prayer and protest. “The system is a rigged game to prevent us from doing our jobs,” argued criminal defense attorney David Nevin, accusing the prison camp commander of making it impossible to learn from alleged mastermind Khalid Sheik Mohammed how the CIA waterboarded him 183 times and used other since-outlawed techniques to break him. “The government wants to kill Mr. Mohammed,” Nevin said, “to extinguish the last eyewitness to his torture.” Each of the accused steadfastly refused to answer basic questions posed to them by Army Col. James L. Pohl, the war court’s chief judge, on whether they accepted their Pentagon-appointed attorneys. Instead, they periodically disrupted the proceedings with demonstrations of Muslim prayer and protests of prison conditions. “These men have endured years of inhumane treatment and torture” that will “infect every aspect of this military commission tribunal,” attorney James Connell III warned.

America's top military officer [the Chairman of the Joint Chiefs of Staff, General Martin Dempsey] has condemned a course taught about Islam at one of America's top military schools as "totally objectionable". The course taught officers there was no such thing as moderate Islam and that they should consider the religion their enemy. It advocated "total war" against all the world's Muslims, including possible nuclear attacks on the holy cities of Mecca and Medina and the wiping out [of] civilian populations. The Pentagon has confirmed [that] the course material found on their website is authentic. This is not ... a rather sick academic exercise in stretching the bounds of what could be thought. It is actually what the officer teaching it believes. In other words: completely nutty stuff that would disgrace the wilder fringes of the blogosphere. The voluntary course aimed at senior officers was taught at the Joint Forces Staff College in Norfolk, Virginia, for a year. It came to light when one of the officers on the course complained last month. There is now an investigation into how the course was approved and why it was part of the curriculum. A lieutenant colonel has been suspended from teaching, but for the moment keeps his job.

The $2 billion trading loss that JPMorgan Chase disclosed late on Thursday provided ample ammunition for supporters of the Volcker Rule, which would restrict government-backed banks' ability to conduct proprietary trading. But it also prompted a fair amount of finger-wagging toward the company, given JPMorgan's stance as one of the rule's fiercest opponents. JPMorgan has been among the most outspoken detractors of the proposed financial regulation that is making its way through Washington. The firm has laid bare its feelings about the Volcker Rule several times, including in a Feb. 13 comment letter to the Federal Reserve. In that document, JPMorgan argued that the proposal would restrict its efforts to rein in risk-taking and would harm the firm's ability to compete against foreign rivals that did not face the same restrictions. In the letter, JPMorgan specifically mentions its chief investment office, the trading group which caused the $2 billion trading loss. JPMorgan also happens to run one of the most active and best-financed lobbying operations within the commercial banking industry. In the first four months of 2012, the firm has spent $1.92 million, barely trailing Wells Fargo in terms of banks' lobbying expenses. Last year, JPMorgan spent $7.62 million; two years ago, it spent $7.41 million, the most in its industry. And JPMorgan's chief, Jamie Dimon has been among the most frequent visitors to Washington to press his case.

The first shock came when Mordechai Jungreis learned that his mentally disabled teenage son was being molested in a Jewish ritual bathhouse in Brooklyn. The second came after Mr. Jungreis complained, and the man accused of the abuse was arrested. Old friends started walking stonily past him and his family on the streets of Williamsburg. Their landlord kicked them out of their apartment. Anonymous messages filled their answering machine, cursing Mr. Jungreis for turning in a fellow Jew. By cooperating with the police, and speaking out about his son’s abuse, Mr. Jungreis, 38, found himself at the painful forefront of an issue roiling his insular Hasidic community. But those who come forward often encounter intense intimidation from their neighbors and from rabbinical authorities, aimed at pressuring them to drop their cases. Abuse victims and their families have been expelled from religious schools and synagogues, shunned by fellow ultra-Orthodox Jews and targeted for harassment intended to destroy their businesses. Some victims’ families have been offered money, ostensibly to help pay for therapy for the victims, but also to stop pursuing charges, victims and victims’ advocates said.
