The growing use of unmanned aircraft in combat situations raises huge moral and legal issues, and threatens to make war more likely as armed robots take over from human beings, according to an internal study by the Ministry of Defence. The report warns of the dangers of an "incremental and involuntary journey towards a Terminator-like reality", referring to James Cameron's 1984 movie, in which humans are hunted by robotic killing machines. "It is essential that before unmanned systems become ubiquitous (if it is not already too late) … we ensure that ... we do not risk losing our controlling humanity and make war more likely," warns the report, titled The UK Approach to Unmanned Aircraft Systems. More than 250 of America's most eminent legal scholars have signed a letter protesting against the treatment in military prison of the alleged WikiLeaks source Bradley Manning, contesting that his "degrading and inhumane conditions" are illegal, unconstitutional and could even amount to torture. The list of signatories includes Laurence Tribe, a Harvard professor who is considered to be America's foremost liberal authority on constitutional law. He told the Guardian he signed the letter because Manning appeared to have been treated in a way that "is not only shameful but unconstitutional" as he awaits court martial in Quantico marine base in Virginia. Under the terms of his detention, he is kept in solitary confinement for 23 hours a day, checked every five minutes under a so-called "prevention of injury order" and stripped naked at night apart from a smock. Tribe said the treatment was objectionable "in the way it violates his person and his liberty without due process of law and in the way it administers cruel and unusual punishment of a sort that cannot be constitutionally inflicted even upon someone convicted of terrible offences, not to mention someone merely accused of such offences". The harsh restrictions have been denounced by a raft of human rights groups, including Amnesty International, and are being investigated by the United Nations' rapporteur on torture.

Last year nearly 50,000 male veterans screened positive for “military sexual trauma” at the Department of Veterans Affairs, up from just over 30,000 in 2003. For the victims, the experience is a special kind of hell -— a soldier can’t just quit his job to get away from his abusers. But now, as the Pentagon has begun to acknowledge the rampant problem of sexual violence for both genders, men are coming forward in unprecedented numbers, telling their stories and hoping that speaking up will help them, and others, put their lives back together. In fact, it is the high victimization rate of female soldiers -— women in the armed forces are now more likely to be assaulted by a fellow soldier than killed in combat -— that has helped cast light on men assaulting other men. Last year more than 110 men made confidential reports of sexual assault by other men, nearly three times as many as in 2007. The real number of victims is surely much higher. Like in prisons and other predominantly male environments, male-on-male assault in the military, experts say, is motivated not by homosexuality, but power, intimidation, and domination. Assault victims, both male and female, are typically young and low-ranking; they are targeted for their vulnerability. “One of the reasons people commit sexual assault is to put people in their place, to drive them out,” says Mic Hunter, author of Honor Betrayed: Sexual Abuse in America’s Military. “Sexual assault isn’t about sex, it’s about violence.”

Commanders in Afghanistan are bracing themselves for possible riots and public fury triggered by the publication of "trophy" photographs of US soldiers posing with the dead bodies of defenceless Afghan civilians they killed. Senior officials at Nato's International Security Assistance Force in Kabul have compared the pictures published by the German news weekly Der Spiegel to the images of US soldiers abusing prisoners in Abu Ghraib in Iraq which sparked waves of anti-US protests around the world. They fear that the pictures could be even more damaging as they show the aftermath of the deliberate murders of Afghan civilians by a rogue US Stryker tank unit that operated in the southern province of Kandahar last year. The case has already created shock around the world, particularly with the revelations that the men cut "trophies" from the bodies of the people they killed. An investigation by Der Spiegel has unearthed approximately 4,000 photos and videos taken by the men. The US military has strived to keep the pictures out of the public domain. A Pentagon audit has found that the federal government overpaid a billionaire oilman by as much as $200 million on several military contracts worth nearly $2.7 billion. The audit by the Defense Departments inspector general ... estimated that the department paid the oilman $160 [million] to $204 million more for fuel than could be supported by price or cost analysis. The study also reported that the three contracts were awarded under conditions that effectively eliminated the other bidders. President Obama signed an executive order Monday that will create a formal system of indefinite detention for those held at the U.S. military prison at Guantanamo Bay, Cuba, who continue to pose a significant threat to national security. The administration also said it will start new military commission trials for detainees there. The announcements, coming more than two years after Obama vowed in another executive order to close the detention center, all but cements Guantanamo Bay's continuing role in U.S. counterterrorism policy. The executive order recognizes the reality that some Guantanamo Bay detainees will remain in U.S. custody for many years, if not for life. Activists on either end of the debate over closing the prison cast the announcement as a reversal. "It is virtually impossible to imagine how one closes Guantanamo in light of this executive order," said Anthony Romero, executive director of the American Civil Liberties Union. "In a little over two years, the Obama administration has done a complete about-face." Recent legislation now makes it extremely difficult to transfer any detainee out of Guantanamo Bay even if he is believed to be no threat.

Reports about what life is like inside the military prison for terrorism suspects at Guantanamo Bay are not uncommon. But very little is reported about two secretive units for convicted terrorists and other inmates who get 24-hour surveillance, right here in the U.S. For the first time, an NPR investigation has identified 86 of the more than 100 men who have lived in the special units that some people are calling "Guantanamo North." The Communications Management Units [CMU] in Terre Haute, Ind., and Marion, Ill., are mostly filled with Muslims. About two-thirds of the inmates identified by NPR are U.S. citizens. Prison officials opened the first CMU with no public notice four years ago, something inmates say they had no right to do under the federal law known as the Administrative Procedures Act. The units' population has included men convicted in well-known post-Sept. 11 cases, as well as defendants from the 1993 World Trade Center bombing, the 1999 "millennium" plot ... and hijacking cases in 1976, 1985 and 1996. When the Terre Haute unit opened in December 2006, 15 of the first 17 inmates were Muslim. As word got out that the special units were disproportionately Muslim ... the Bureau of Prisons started moving in non-Muslims. Guards and cameras watch the CMU inmates' every move. Every word they speak is picked up by a counterterrorism team that eavesdrops from West Virginia. [Several] inmates have been suing the Federal Bureau of Prisons. They say the special units were set up outside the law and raise serious due process issues. Unlike prisoners who are convicted of serious crimes and sent to a federal supermax facility, CMU inmates have no way to review the evidence that sent them there or to challenge that evidence to get out.

The US Army has announced it is to charge Private Bradley Manning with "aiding the enemy" – which can carry the death penalty – and 21 further offences of illegally disclosing classified information, after an investigation lasting seven months. The 22 new charges are in addition to the 12 counts of leaking classified information and computer fraud that Manning already faces over material said to be related to the WikiLeaks disclosures – and for which he has been held in military custody since May last year. The army's charge sheet states that Manning did "knowingly give intelligence to the enemy, through indirect means," in violation of article 104 of the Uniform Code of Military Justice, known as "aiding the enemy". The other new charges include wrongfully causing intelligence to be published on the internet knowing it will be accessed by the enemy, five counts of thefts of public property or records, eight counts of transmitting national defense information to someone not entitled to receive it – violating the Espionage Act, two counts of computer fraud, and five counts of breaking US Army computer security rules. The Army's prosecution team said in a statement that if Manning were convicted of all charges, he would face life in prison.

The U.S. Army illegally ordered a team of soldiers specializing in "psychological operations" to manipulate visiting American senators into providing more troops and funding for the war. The orders came from the command of Lt. Gen. William Caldwell, a three-star general in charge of training Afghan troops – the linchpin of U.S. strategy in the war. Over a four-month period last year, a military cell devoted to what is known as "information operations" at Camp Eggers in Kabul was repeatedly pressured to target visiting senators and other VIPs who met with Caldwell. When the unit resisted the order, arguing that it violated U.S. laws prohibiting the use of propaganda against American citizens, it was subjected to a campaign of retaliation. "My job in psy-ops is to play with people's heads, to get the enemy to behave the way we want them to behave," says Lt. Colonel Michael Holmes, the leader of the IO unit, who received an official reprimand after bucking orders. "I'm prohibited from doing that to our own people. When you ask me to try to use these skills on senators and congressman, you're crossing a line." Those singled out in the campaign included senators John McCain, Joe Lieberman, Jack Reed, Al Franken and Carl Levin; Rep. Steve Israel of the House Appropriations Committee; Adm. The top U.S. military commander in Afghanistan intends to order an investigation into whether a three-star general responsible for training Afghan security forces inappropriately used members of a psychological operations team to influence visiting U.S. senators into providing more funding for the war. The U.S. command in Kabul issued a statement Thursday saying Gen. David H. Petraeus "is preparing to order an investigation to determine the facts and circumstances surrounding the issue." The investigation stems from an article published ... on the Web site of Rolling Stone magazine alleging that Lt. Gen. William Caldwell, the head of the U.S. and NATO training operation for Afghan forces, used an "information operations" team to "manipulate visiting American senators" and other visitors, including the chairman of the Joint Chiefs of Staff, Adm. For eight years, government officials turned to Dennis Montgomery, a California computer programmer, for eye-popping technology that he said could catch terrorists. Now, federal officials want nothing to do with him and are going to extraordinary lengths to ensure that his dealings with Washington stay secret. The Justice Department, which in the last few months has gotten protective orders from two federal judges keeping details of the technology out of court, says it is guarding state secrets that would threaten national security if disclosed. But others involved in the case say that what the government is trying to avoid is public embarrassment over evidence that Mr. Montgomery bamboozled federal officials. A onetime biomedical technician with a penchant for gambling, Mr. Montgomery is at the center of a tale that features terrorism scares, secret White House briefings, backing from prominent Republicans, backdoor deal-making and fantastic-sounding computer technology. Mr. Montgomery and his associates received more than $20 million in government contracts by claiming that software he had developed could help stop Al Qaeda’s next attack on the United States. But the technology appears to have been a hoax, and a series of government agencies, including the Central Intelligence Agency and the Air Force, repeatedly missed the warning signs, the records and interviews show.

A US judge has quashed a lawsuit by an American who said he was illegally detained and repeatedly tortured for three years in a US navy jail. Jose Padilla was seeking to sue current US Defence Secretary Robert Gates and his predecessor, Donald Rumsfeld, for violating the constitution. Judge Richard Gergel ruled that US laws did not offer clear guidelines on the detention of enemy combatants. Any trial, he wrote, would be "an international spectacle with Padilla, a convicted terrorist, summoning America's present and former leaders to a federal courthouse to answer his charges". Ben Wizner, the litigation director at the American Civil Liberties Union, called Thursday's ruling "troubling". "The court today held that Donald Rumsfeld is above the law and Jose Padilla is beneath it," he said in a statement. "But if the law does not protect Jose Padilla, it protects none of us, and the executive branch can simply label citizens enemies of the state and strip them of all rights, including the absolute right not to be tortured."

More than a dozen U.S. veterans who say they were raped or assaulted by comrades filed a class-action suit in federal court [on February 15] attempting to force the Pentagon to change how it handles such cases. The current and former service members - 15 women and two men - describe circumstances in which servicemen allegedly got away with rape and other sexual abuse while their victims were ordered to continue to serve with them. The alleged attackers in the lawsuit include an Army criminal investigator and an Army National Guard commander. The abuse alleged ranges from obscene verbal abuse to gang rape. "The problem of rape in the military is not only service members getting raped, but it's the entire way that the military as a whole is dealing with it," said Panayiota Bertzikis, who is a plaintiff in the lawsuit and claims she was raped in 2006. "From survivors having to be involuntarily discharged from service, the constant verbal abuse, once a survivor does come forward your entire unit is known to turn their back on you. The entire culture needs to be changed."

United States taxpayers have funneled more than $60 billion of aid into Egypt since President Hosni Mubarak came to power in 1981, but more than half of the money has been spent supplying weapons to the country’s military. About $34 billion of the aid to Egypt has come in the form of grants that Congress requires Egypt to spend on American military hardware. In recent years the large amount of aid earmarked for the military, and the relatively low sums supporting civilian aid, have attracted scathing criticism from Egyptians, some of whom argue that US aid has gone to entrench a military dictator at the expense of the fledgling democracy activists. During the early turmoil, protesters were the target of tear gas canisters that read "made in the USA," fueling debate about the aid. Last year, Egypt was the fifth-largest recipient of US aid, getting $1.6 billion. Congress ... authorized major aid packages to both [Egypt and Israel in 1979], using an informal formula — not enshrined in the peace treaty — that gave Egypt $2 for every $3 that Israel received. Israel quickly became the largest recipient of US aid, and Egypt the second-largest — rankings that were only recently overtaken by wars in Afghanistan and Iraq, and last year, the disaster in Haiti. The strong interest of US companies could help explain why US military assistance to Egypt has remained at $1.3 billion a year, while its civilian economic assistance has steadily shrunk, from $815 million a decade ago to $250 million requested for 2011. The decline began in 1998, when Israel arranged for a reduction in economic support and an increase military aid. As Israeli’s economic aid shrunk, so too did Egypt’s.

A mock city roughly the size of downtown San Diego has risen in a remote Southern California desert to train military forces to fight in urban environments. The $170 million urban training center was unveiled [on January 25] at the Twentynine Palms military base, 170 miles northeast of San Diego. The 1,560-building facility will allow troops to practice and refine skills that can be used around the world, the Marine Corps said. The military has been opening a slew of mock Afghan villages at bases across the country to prepare troops for battle before they are deployed. The new training center is one of the largest and most elaborate. Seven separate mock city districts spread across 274 acres of desert. The facility has almost 1,900 feet of underground tunnels, a manmade riverbed and dozens of courtyards and compounds. More than 15,000 Marines and sailors can train simultaneously in the massive simulator to experience the difficulties they will face during deployments. The new center expanded a similar training program called Mojave Viper that launched in 2005 to prepare troops for the Iraq war. In November, the Marine Corps unveiled a $30 million expansion of its mock Afghan village at Camp Pendleton that nearly quadrupled its size. Similar immersion training facilities are slated to open this year at Marine Corps bases in North Carolina, Hawaii and Okinawa.

Fifty years ago this month, President Dwight D. Eisenhower, in his farewell address to Americans, cautioned that the "military-industrial complex" must never be allowed to "endanger our liberties or democratic processes." Despite his warning, William Hartung argues, defense contractors like Lockheed Martin have ballooned in size, scope, and influence. Hartung, the director of the Arms and Security Initiative at the New America Foundation, recently spoke with U.S. News about his new book, Prophets of War. "The military-industrial complex [is] really about the conjunction between the military itself, the weapons contractors, and in some degree the Congress. And it deals with how they kind of work in tandem to lobby for perhaps higher levels of military spending than we might otherwise need," [explained Hartung]. "The biggest Pentagon contractor [is} Lockheed Martin. They got $29 billion in Pentagon awards, which is about $6 billion more than the next company. And they are involved in almost the full gamut of weapons programs. Other than pistols or semi-automatic rifles, they make almost everything the Pentagon would want." Defense contractors ... actually help to finance think tanks that then advocate policies - whether it be regime change in Iraq or a different approach to nuclear weapons policy - that, if pursued, would be of benefit to the company. Then there's the relationship with Congress. They are very strategic in how they give money." Military spending is twice what it was under Eisenhower.

The Pentagon porn story began in 2006. An Immigration and Customs Enforcement [ICE] child pornography sting operation called Project Flicker produced payment records of about 5,200 people, many of whom provided Army or fleet zip codes or military e-mail addresses. Subsequently, the Pentagon's investigative branch, DCIS, began going through the ICE list to identify who actually was a DOD employee. The investigation, however, only ran for eight months, and only cross-checked some 3,500 names for Pentagon ties. According to DCIS documents revealed in a Freedom of Information Act request, out of that 3,500, investigators uncovered 264 employees or contractors, including staffers for the secretary of defense. Nine people had top security clearances. But only about 20 percent of those 264 people were completely investigated. Fewer still were prosecuted. After about eight months, the entire probe was halted. It left about 1,700 names totally unchecked, 1,700 alleged kiddie porn customers, an unknown number of whom may still work in some capacity for the Defense Department. Late last summer, after investigations by "The Boston Globe" and Yahoo! News revealed the figures, a Pentagon spokesman promised to reopen the investigation, conceding that DCIS had stopped due to lack of resources. DCIS says it is now revisiting all 5,200 names. They have now identified 302 employees or staffers. [Yet] of the 302 people confirmed as DOD personnel or contractors, only 70 of them were actually investigated.

The Army's official history of the battle of Wanat - one of the most intensely scrutinized engagements of the Afghan war - largely absolves top commanders of the deaths of nine U.S. soldiers and instead blames the confusing and unpredictable nature of war. An initial draft of the Wanat history, which was obtained by The Washington Post and other media outlets in the summer of 2009, placed the preponderance of blame for the losses on the higher-level battalion and brigade commanders who oversaw the mission, saying they failed to provide the proper resources to the unit in Wanat. The final history, released in recent weeks, drops many of the earlier conclusions and instead focuses on failures of lower-level commanders. Family members of the deceased at Wanat reacted with anger and disappointment to the final version of the Army history. "They blame the platoon-level leadership for all the mistakes at Wanat," said retired Col. David Brostrom, whose son was killed in the fighting. "It blames my dead son. They really missed the point." The initial investigation, conducted by a three-star Marine Corps general and completed in the spring, found that the company and battalion commanders were "derelict in their duty" to provide proper oversight and resources to the soldiers fighting at Wanat.

The Obama administration is preparing an executive order that would formalize indefinite detention without trial for some detainees at the U.S. military prison at Guantanamo Bay, Cuba ..., U.S. officials said. Some civil liberties groups oppose any form of indefinite detention. "Indefinite detention without charge or trial is wrong, whether it comes from Congress or the president's pen," said Laura W. Murphy, director of the American Civil Liberties Union's Washington legislative office. "Our Constitution requires that we charge and prosecute people who are accused of crimes. You cannot sell an indefinite detention scheme by attaching a few due-process baubles and expect that to restore the rule of law. That is bad for America and is not the form of justice we want other nations to emulate." Legislation supported by some Republicans ... would create a system of indefinite detention not only for some Guantanamo detainees but also for future terrorism suspects seized overseas.
