The U.S. federal-prison population swelled from 24,000 prisoners in 1980 to 219,000 in 2013. And federal prisons are just the tip of the iceberg — factor in state prisons and local jails, and there are 2.2 million people locked up in this country. The U.S. Sentencing Commission ... is charged with setting and adjusting the detailed schedule of penalties for those convicted of federal crimes. In April 2014, the commission approved a reduction in sentences for certain drug crimes going forward. In his final months in office, President Obama has focused more on the need for criminal-justice reform. He has used the executive power of clemency to commute some of the most egregiously unfair sentences of 89 federal drug convicts. But a handful of pardons don't amount to much when there are hundreds of thousands of federal prisoners. Nearly half of federal inmates are serving time for drug crimes. Of those, 60 percent were subject to mandatory minimums when they were sentenced. Stephanie George was a 26-year-old mother of three when she was convicted on drug-conspiracy charges because the man she was dating had kept drugs and money in her house. Under the federal three-strikes-and-you're-out law, she was sentenced to life in prison. George was locked up nearly 18 years before Obama commuted her sentence. One of her sons died shortly before her release. She says she doesn't think most politicians consider the costs a mandatory-minimum sentence brings.

Now that we have built The Counted, a definitive record of people killed by police in the US this year, at least there is some accountability in America – even if data from the rest of the world is still catching up. It is undeniable that police in the US often contend with much more violent situations and more heavily armed individuals than police in other developed democratic societies. Still, looking at our data for the US against admittedly less reliable information on police killings elsewhere paints a dramatic portrait: the US is not just some outlier in terms of police violence when compared with countries of similar economic and political standing. America is the outlier – and this is what a crisis looks like. There were 59 fatal police shootings in the US for the days between 1 January and 24 January. According to data collected by the UK advocacy group Inquest, there have been 55 fatal police shootings – total – in England and Wales from 1990 to 2014. The US population is roughly six times that of England and Wales. According to the World Bank, the US has a per capita intentional homicide rate five times that of the UK. There has been just one fatal shooting by Icelandic police in the country’s 71-year history. The city of Stockton, California – with 25,000 fewer residents than all of Iceland combined – had three fatal encounters in the first five months of 2015. Police in the US have shot and killed more people – in every week this year – than are reportedly shot and killed by German police in an entire year.

Whitewashing AIDS History

Dr. Anthony Fauci is rewriting history. He is doing so to disguise his shameful role in delaying promotion of an AIDS treatment that would have prevented tens of thousands of deaths in the first years of the epidemic. In my book, Body Counts, A Memoir of Politics, Sex, AIDS, and Survival, I recount how slow the federal government was in publicizing the use of Bactrim and other sulfa drugs to prevent PCP (the pneumonia that was then the leading killer of people with AIDS). Had Fauci listened to people with AIDS and the clinicians treating them, and responded accordingly, he would have saved thousands of lives. Between 1987, when [AIDS activist Michael] Callen met with Fauci and 1989, when the guidelines were ultimately issued, nearly 17,000 people with AIDS suffocated from PCP. Most of these people might have lived had Fauci responded appropriately. Callen and others ... met with Fauci to plead for his support. They explained that many frontline AIDS physicians, following the lead of Dr. Joseph Sonnabend, were already using Bactrim effectively to prevent the recurrence of PCP. The science was clear. Fauci refused to acknowledge the evidence and, according to one account, even encouraged people with AIDS to stop taking treatments, like Bactrim. Treatment activist Richard Jefferys wrote in 2001 that Fauci "went as far as telling activists attending a 1987 meeting that there was no data to suggest PCP prophylaxis was beneficial and that it may, in fact be dangerous."

Did you know that the United States, Canada, Britain, Australia, and New Zealand participate together in an electronic eavesdropping cooperative called "The Five Eyes Alliance"? Or that Britain "has secretly gained access to the network of cables which carry the world's phone calls and internet traffic and has started to process vast streams of sensitive personal information which it is sharing with its American partner, the National Security Agency"? One key innovation has been GCHQ's ability to tap into and store huge volumes of data drawn from fibre-optic cables for up to 30 days so that it can be sifted and analysed. GCHQ and the NSA are consequently able to access and process vast quantities of communications between entirely innocent people, as well as targeted suspects. This includes recordings of phone calls, the content of email messages, entries on Facebook and the history of any internet user's access to websites - all of which is deemed legal, even though the warrant system was supposed to limit interception to a specified range of targets. Say you're the NSA. By law, there are certain sorts of spying you're not lawfully allowed to do on Americans. (And agency rules constraining you too.) But wait. Allied countries have different laws and surveillance rules. Put bluntly, intelligence agencies have an incentive to make themselves complicit in foreign governments spying on their own citizens.

The Next Pandemic: Bird Flu, or Fear?

What are the essentials of President Bush's plan for bird flu pandemic preparedness? The plan calls for a $7.1 billion total expenditure. The president proposes that $2 billion of this would be devoted to stockpiling antiviral medications and 20 million doses of an experimental vaccine against the bird flu strain H5N1. $2.7 billion would go toward vaccine research and upgrading our methods of vaccine manufacture. Federal dollars would be invested in an international flu-surveillance network, and federal funding to state and local public health agencies would be boosted by $100 million. Critics of the plan say that far too little is designated for the state and local agencies or for fighting bird flu in Asia, where it is currently (only $251 million would be spent overseas). Critics also have complained that the plan doesn't provide for improving the hospital infrastructure for disaster response. According to Dr. Irwin Redlener ... at Columbia University: "Less than seven percent of that budget could be construed as going towards anything that would help bolster a very ailing hospital system in the United States. Which in fact would be the only recourse that we would have if, in fact, we're dealing with a race against time. And if it becomes real that we get a pandemic prior to the development of sufficient capacity to contain, to vaccinate and to treat with specific antivirals, then all we have left is a health and hospital system ... we'll find that we don't have sufficient isolation beds, intensive care beds, ventilators, et cetera, et cetera."

The U.S. press, like the U.S. government, is a corrupt and troubled institution. Corrupt not so much in the sense that it accepts bribes but in a systemic sense. It fails to do what it claims to do, what it should do, and what society expects it to do. The news media and the government are entwined in a vicious circle of mutual manipulation, mythmaking, and self-interest. Journalists need crises to dramatize news, and government officials need to appear to be responding to crises. Too often, the crises are not really crises but joint fabrications. The two institutions have become so ensnared in a symbiotic web of lies that the news media are unable to tell the public what is true and the government is unable to govern effectively. That is the thesis advanced by Paul H. Weaver, a former political scientist (at Harvard University), journalist (at Fortune magazine), and corporate communications executive (at Ford Motor Company), in his provocative analysis entitled News and the Culture of Lying: How Journalism Really Works. What has emerged, Weaver argues, is a culture of lying. “The culture of lying,” he writes, “is the discourse and behavior of officials seeking to enlist the powers of journalism in support of their goals, and of journalists seeking to co-opt public and private officials into their efforts to find and cover stories of crisis and emergency response. In such an environment, the actors who most skillfully create and manipulate crises determine the direction of change.

On June 1, 1951, top military and intelligence officials of the United States, Canada and Great Britain, alarmed by frightening reports of communist success at "intervention in the individual mind," summoned a small group of eminent psychologists to a secret meeting at the Ritz-Carlton Hotel in Montreal. By the following September, U.S. government scientists, spurred on by reports that American prisoners of war were being brainwashed in North Korea, were proposing an urgent, top-secret research program on behavior modification. Drugs, hypnosis, electroshock, lobotomy - all were to be studied as part of a vast U.S. effort to close the mind-control gap. From the end of World War II well into the 1970s, the Atomic Energy Commission, the Defense Department, the military services, the CIA and other agencies used prisoners, drug addicts, mental patients, college students, soldiers, even bar patrons, in a vast range of government-run experiments to test the effects of everything from radiation, LSD and nerve gas to intense electric shocks and prolonged "sensory deprivation." Some of the human guinea pigs knew what they were getting into; many others did not. With the cold war safely over, Energy Secretary Hazel O'Leary has ordered the declassification of millions of pages of documents on the radiation experiments. But the government has long ignored thousands of other cold war victims, rebuffing their requests for compensation and refusing to admit its responsibility for injuries they suffered.

The C.D.C. Isn't Publishing Large Portions of the Covid Data It Collects

For more than a year, the Centers for Disease Control and Prevention has collected data on hospitalizations for Covid-19 in the United States and broken it down by age, race and vaccination status. But it has not made most of the information public. When the C.D.C. published the first significant data on the effectiveness of boosters in adults younger than 65 two weeks ago, it left out the numbers for a huge portion of that population: 18- to 49-year-olds, the group least likely to benefit from extra shots, because the first two doses already left them well-protected. The agency recently debuted a dashboard of wastewater data on its website that will be updated daily and might provide early signals of an oncoming surge of Covid cases. Some states and localities had been sharing wastewater information with the agency since the start of the pandemic, but it had never before released those findings. Two full years into the pandemic, the agency leading the country's response to the public health emergency has published only a tiny fraction of the data it has collected, several people familiar with the data said. But the C.D.C. has been routinely collecting information since the Covid vaccines were first rolled out last year. The agency has been reluctant to make those figures public, [an] official said, because they might be misinterpreted as the vaccines being ineffective. The National Institute of Health (NIH) has denied funding studies that would make a coronavirus more dangerous to humans after it was accused of doing so following the release of research proposals. The documents were obtained and released by The Intercept. Richard Ebright, board of governors professor of chemistry and chemical biology at Rutgers University ... told Newsweek these documents show "unequivocally" that NIH grants were used to fund controversial gain-of-function (GOF) research at the Wuhan Institute of Virology in China–something U.S. infectious disease expert Dr. Anthony Fauci has denied. GOF research ... potentially makes the virus more dangerous to humans.. Fauci, the director of the National Institute of Allergy and Infectious Diseases (NIAID), which is part of the NIH, told Congress in May that the NIH "has not ever and does not now fund gain-of-function research in the Wuhan Institute of Virology." Ebright said: "The documents make it clear that assertions by the NIH director, Francis Collins, and the NIAID director, Anthony Fauci ... are untruthful." What the NIH has denied is funding GOF research that would make a coronavirus more dangerous, such as by improving its lethality or transmissibility. Ebright said this appeared to be false by his interpretation of the documents released by The Intercept. NIH grants supported the construction of mutant SARS-related coronaviruses. Now that the 2020 figures have been properly tallied, there is still no convincing evidence that strict lockdowns reduced the death toll from COVID-19. But one effect is clear: more deaths from other causes, especially among the young and middle-aged, minorities and the less affluent. The best gauge of the pandemic's impact is what statisticians call excess mortality, which compares the overall number of deaths with the total in previous years. That measure rose among older Americans because of COVID-19, but it rose at an even sharper rate among people aged 15 to 54, and most of those excess deaths weren't attributed to the virus. Preliminary reports point to some obvious lockdown-related factors. There was a sharp decline in visits to emergency rooms and an increase in fatal heart attacks because patients didn't receive prompt treatment. Many fewer people were screened for cancer. Social isolation contributed to excess deaths from dementia and Alzheimer's. Researchers predicted that the social and economic upheaval would lead to tens of thousands of "deaths of despair" from drug overdoses, alcoholism and suicide. As unemployment surged and mental-health and substance-abuse treatment programs were interrupted, the reported levels of anxiety, depression and suicidal thoughts increased dramatically, as did alcohol sales and fatal drug overdoses. The number of excess deaths not involving COVID-19 has been especially high in US counties with more low-income households and minority residents.

BlackRock Is Now ‘Fourth Branch of Government'

When the Federal Reserve needed Wall Street's help with its pandemic rescue mission, it went straight to Larry Fink. The BlackRock cofounder, chairman, and chief executive officer has become one of the industry's most important government whisperers. The company's new assignment is a much bigger version of one it took on after the 2008 financial crisis, when the Federal Reserve enlisted it to dispose of toxic mortgage securities. This time it will help the Fed prop up the entire corporate bond market by purchasing, on the central bank's behalf, what could become a $750 billion portfolio of debt. One part of the Fed's plan is to buy bond exchange-traded funds. BlackRock itself runs ETFs under the iShares brand, and could end up buying funds it manages. "BlackRock is acting as a fiduciary to the Federal Reserve Bank of New York," says a spokesman for the company. "As such, BlackRock will execute this mandate at the sole discretion of the bank." The arrangement is bringing new attention to the company's scale and ubiquity. "It's impossible to think of BlackRock without thinking of them as a fourth branch of government," says William Birdthistle, a professor at the Chicago-Kent College of Law. BlackRock's growth raises questions over how big and useful a company can become before its size poses a risk. And then there are the potential conflicts. One arm of BlackRock knows what the Fed is buying, while other parts of the business participating in credit markets could benefit from that knowledge.

Covid-19 — Navigating the Uncharted - by Anthony Fauci, et al

The latest threat to global health is the ongoing outbreak of the respiratory disease that was recently given the name Coronavirus Disease 2019 (Covid-19). The Covid-19 outbreak has posed critical challenges for the public health, research, and medical communities. In their Journal article, Li and colleagues provide a detailed clinical and epidemiologic description of the first 425 cases reported in the epicenter of the outbreak: the city of Wuhan in Hubei province, China. A degree of clarity is emerging from this report. The median age of the patients was 59 years, with higher morbidity and mortality among the elderly and among those with coexisting conditions (similar to the situation with influenza). Of note, there were no cases in children younger than 15 years of age. Li et al. report a mean interval of 9.1 to 12.5 days between the onset of illness and hospitalization. On the basis of a case definition requiring a diagnosis of pneumonia, the currently reported case fatality rate is approximately 2%. In another article in the Journal, Guan et al. report mortality of 1.4% among 1099 patients with laboratory-confirmed Covid-19; these patients had a wide spectrum of disease severity. If one assumes that the number of asymptomatic or minimally symptomatic cases is several times as high as the number of reported cases, the case fatality rate may be considerably less than 1%. This suggests that the overall clinical consequences of Covid-19 may ultimately be more akin to those of a severe seasonal influenza (which has a case fatality rate of approximately 0.1%) or a pandemic influenza (similar to those in 1957 and 1968) rather than a disease similar to SARS or MERS, which have had case fatality rates of 9 to 10% and 36%, respectively.

In this unnervingly persuasive HBO documentary, directors Simon Ardizzone, Russell Michaels and Sarah Teale marshal cyber-security experts, statisticians and lawmakers to expose cracks in the system that could easily allow hackers to affect voting results. The filmmakers' sources also include actual hackers, among them an individual who breached Alaska's voting system in 2016 just to see if he could. One of the central figures of Kill Chain is election-security expert Harri Hursti, who explains, with clarity, just how vulnerable American voting systems are. Although voting machines are supposed to be kept in secure facilities, Hursti found a widely used model for sale - on eBay. The vendor had hundreds of them. Hursti bought a few, using them to explain how easily their workings could be examined and breached. He also brought a selection of voting machines to Def Con, a three-day conference for hackers, and invited attendees to go at them; one expert quickly figured out how to shut down a machine remotely from a laptop. The U.S. voting system is, as several interviewees in Kill Chain put it, a bipartisan concern; still, as the documentary notes, Senate majority leader Mitch McConnell has blocked votes on the Secure Elections Act and four similar bipartisan bills.

In Coronavirus Fight, China Gives Citizens a Color Code, With Red Flags

As China encourages people to return to work despite the coronavirus outbreak, it has begun a bold mass experiment in using data to regulate citizens’ lives — by requiring them to use software on their smartphones that dictates whether they should be quarantined or allowed into subways, malls and other public spaces. The system does more than decide in real time whether someone poses a contagion risk. It also appears to share information with the police, setting a template for new forms of automated social control that could persist long after the epidemic subsides. The Alipay Health Code, as China’s official news media has called the system, was first introduced in the eastern city of Hangzhou ... with the help of Ant Financial, a sister company of the e-commerce giant Alibaba. People in China sign up through Ant’s popular wallet app, Alipay, and are assigned a color code — green, yellow or red — that indicates their health status. The system is already in use in 200 cities and is being rolled out nationwide, Ant says. As soon as a user grants the software access to personal data, a piece of the program labeled “reportInfoAndLocationToPolice” sends the person’s location, city name and an identifying code number to a server. The software does not make clear to users its connection to the police. In the United States, it would be akin to the Centers for Disease Control and Prevention using apps from Amazon and Facebook to track the coronavirus, then quietly sharing user information with the local sheriff’s office.

Each year, state lawmakers across the U.S. introduce thousands of bills dreamed up and written by corporations, industry groups and think tanks. Disguised as the work of lawmakers, these so-called “model” bills get copied in one state Capitol after another, quietly advancing the agenda of the people who write them. A two-year investigation by USA TODAY, The Arizona Republic and the Center for Public Integrity reveals for the first time the extent to which special interests have infiltrated state legislatures using model legislation. USA TODAY and the Republic found at least 10,000 bills almost entirely copied from model legislation were introduced nationwide in the past eight years, and more than 2,100 of those bills were signed into law. In a separate analysis, the Center for Public Integrity identified tens of thousands of bills with identical phrases, then traced the origins of that language. Model bills passed into law have ... limited access to abortion and restricted the rights of protesters. In all, these copycat bills amount to the nation’s largest, unreported special-interest campaign, driving agendas in every statehouse and touching nearly every area of public policy. USA TODAY found more than 4,000 bills benefiting industry were introduced nationwide during the eight years it reviewed. The US government-funded ‘private social network' attacking pesticide critics

Industry advocates have established a "private social network" to counter resistance to pesticides and genetically modified (GM) crops in Africa, Europe and other parts of the world, while also denigrating organic and other alternative farming methods. In 2017, two United Nations experts called for a treaty to strictly regulate dangerous pesticides, which they said were a "global human rights concern", citing scientific research showing pesticides can cause cancers, Parkinson's disease, Alzheimer's and other health problems. Derogatory profiles of the two UN experts, Hilal Elver and Baskut Tuncak, are hosted on an online private portal for pesticide company employees and a range of influential allies. [These] efforts were spearheaded by a "reputation management" firm ... called v-Fluence. The company then launched a platform called Bonus Eventus, named after the Roman god of agriculture whose name translates to "good outcome". Bonus Eventus is invite-only and counts more than 1,000 members. They include executives from the world's largest agrochemical companies and their lobbyists, as well as academics, government officials and high-profile policymakers. The individuals profiled in the portal include more than 500 environmental advocates, scientists, politicians and others seen as opponents of pesticides and GM crops. Many profiles include personal details such as the names of family members, phone numbers, home addresses and even house values. The profiling is part of an effort – that was financed, in part, by US taxpayer dollars – to downplay pesticide dangers, discredit opponents and undermine international policymaking. Federal court rules against EPA in lawsuit over fluoride in water

A federal court in California ruled late Tuesday against the Environmental Protection Agency, ordering officials to take action over concerns about potential health risks from currently recommended levels of fluoride in the American drinking water supply. The ruling by District Court Judge Edward Chen ... deals a blow to public health groups in the growing debate about whether the benefits of continuing to add fluoride to the water supply outweighs its risks. While Chen was careful to say that his ruling "does not conclude with certainty that fluoridated water is injurious to public health," he said that evidence of its potential risk was now enough to warrant forcing the EPA to take action. "In all, there is substantial and scientifically credible evidence establishing that fluoride poses a risk to human health; it is associated with a reduction in the IQ of children and is hazardous at dosages that are far too close to fluoride levels in the drinking water of the United States," the judge wrote in his ruling. The judge's ruling cites a review by the National Institutes of Health's toxicology program finalized last month, which concluded that "higher levels" of fluoride is now linked to lowered IQ in children. Chen said he left it up to the EPA which of a number of options the agency could take in response to his ruling. They range from a warning label about fluoride's risks at current levels to taking steps towards tightening restrictions on its addition to drinking water.

How Honduras's Narco-State Leaders Fell Out With Washington

Honduras's former president Juan Orlando Hernández has been jailed in the US for drug trafficking. But the narco-state he ran was a product of US foreign policy and of the US-backed coup against Manuel Zelaya's left-wing government. By the time Hernández was extradited to the United States on April 22, 2022, the former director of the Honduran police was already in US custody. Juan Carlos Bonilla, known as "El Tigre" and trained and educated at Fort Moore, Georgia, was on August 2 sentenced to nineteen years in prison in the United States. Bonilla had been a "highly trusted" torpedo loyal to the Hernández tribe. According to a Justice Department press release, the president and his brother had "El Tigre" shielding their drug shipments while also conducting "special assignments, including murder" of a rival trafficker. In heading the Honduran police, Bonilla also organized the return of death squads, tasked with "socially cleansing" Honduras of environmental activists, indigenous spokespersons, and investigative reporters. Hernández began his second term in 2017 atop a heap of killed and tear-gased protesters. [Honduras] was, according to Honduras scholar Dana Frank, "the first domino that the United States pushed over to counteract the new governments in Latin America." After Honduras, a parliamentary coup took place against Paraguay's progressive president Fernando Lugo in 2012, Brazilian president Dilma Rousseff was impeached in 2015, and Brazil's current president Luiz Inácio Lula da Silva was sentenced to a now-annulled prison sentence in 2017. Obama, hailed as the US president of "hope" and "change," oversaw all three modern coups that overthrew left-leaning governments in favor of undemocratic, conservative, and US-friendly replacements.

During his final three years at the US Food and Drug Administration the physician scientist Doran Fink's work focused on reviewing covid-19 vaccines. But a decade after joining the agency Fink had accepted a job with Moderna, the covid vaccine manufacturer. As he left for the private sector, the FDA's ethics programme staff emailed him guidelines on post-employment restrictions, "tailored to your situation." The email, obtained by The BMJ under a freedom of information request, explained that, although US law prohibits a variety of types of lobbying contact, "they do not prohibit the former employee from other activities, including working ‘behind the scenes.'" The legal ability to work "behind the scenes" is enshrined in federal regulations and highlights a "critical, critical loophole" in US revolving door policy. Craig Holman, a government affairs lobbyist for the organisation Public Citizen, told The BMJ that the rules forbid various forms of direct lobbying contact but permit lobbying activity that is indirect. "So, people will leave government service and can immediately start doing influence peddling and lobbying," Holman explained. "They can even run a lobbying campaign, as long as they don't actually pick up the telephone and make the contact with their former officials." A majority of former FDA reviewers take up jobs in industry. Since 2000 every FDA commissioner, the agency's highest position, has gone on to work for industry.

Florida prosecutors heard graphic testimony about how the late millionaire and financier Jeffrey Epstein sexually assaulted teenage girls two years before they cut a plea deal, according to transcripts released Monday of the 2006 grand jury investigation. Epstein's ties to the rich and the powerful seems to have allowed him to continue to rape and sex traffic teenagers. Transcripts show that the grand jury heard testimony that Epstein, who was then in his 40s, had raped teenage girls as young as 14 at his Palm Beach mansion. The teenagers testified and told detectives they were also paid to find him more girls. After the grand jury investigation, Epstein cut a deal with South Florida federal prosecutors in 2008 that allowed him to escape more severe federal charges and instead plead guilty to state charges of procuring a person under 18 for prostitution and solicitation of prostitution. He was sentenced to one and a half years in the Palm Beach County jail system, followed by a year of house arrest. He was required to register as a sex offender. According to the transcripts, Palm Beach Police Det. Joe Recarey testified in July 2006 that the initial investigation began when a woman reported in March 2005 that her stepdaughter who was in high school at the time said she received $300 in exchange for "sexual activity with a man in Palm Beach," Recarey testified. Another teenager ... told detectives that she was 17 years old when she was approached by a friend who said she could make $200 by providing a massage at Epstein's home. Epstein told her that he would pay her if she brought other "girls" to his home. "And he told her, ‘The younger, the better,'" Recarey said.
